Art. 7 Registerföring av transaktioner | RTS on record keeping | MiCA

This article deals with the post-transaction recording obligations of crypto-asset service providers.

It establishes that once a transaction has been undertaken, the relevant details must be recorded immediately, referencing specific tables in the Annex for what must be captured.

It also addresses what happens when competent authorities request that information, narrowing the obligation to respond to operators of trading platforms for crypto-assets specifically, who must then provide details as laid out in a designated column of the Annex.

This article complements Article 6, which covers the recording of orders and decisions to deal, by focusing on the transaction execution stage itself.

Important points:

Record transaction details immediately after undertaking a transaction, in line with the fields specified in the Annex.
When competent authorities request transaction details, operators of trading platforms for crypto-assets are required to provide the information set out in the fourth column of Table 3 of Section 3 of the Annex.
The scope of who must respond to a competent authority request is narrower than the general recording obligation, applying specifically to trading platform operators rather than all crypto-asset service providers.

Leverantörer av kryptotillgångstjänster bör fritt kunna fastställa hur de ska dokumentera relevanta uppgifter om alla order och transaktioner i kryptotillgångar. Enhetlig och jämförbar dokumentation om tjänster, verksamhet, order och transaktioner är dock avgörande för att de behöriga myndigheterna ska kunna fullgöra sina tillsynsuppgifter och vidta åtgärder för efterlevnad. I synnerhet bör de behöriga myndigheterna kunna utföra samma analys av alla registerdatauppsättningar, oavsett vilken leverantör av kryptotillgångstjänster som har utarbetat registret. Leverantörer av kryptotillgångstjänster bör därför tillhandahålla konsekventa uppgifter om register över tjänster, verksamhet, order och transaktioner genom att använda enhetliga standarder när en behörig myndighet begär sådan information i enlighet med artikel 94 i förordning (EU) 2023/1114. Av samma skäl är det nödvändigt att specificera att registren bör föras på ett medium som möjliggör effektiv tillsyn från de behöriga myndigheternas sida.
