Summary What does Article 3 of the RTS on record keeping say?

This article sets out record-keeping obligations for crypto-asset service providers specifically concerning their internal policies and procedures.

Beyond simply retaining the written policies themselves, it extends the requirement to also capture the ongoing governance activity around those policies, namely the management body's assessments and periodic reviews of their effectiveness, findings of any deficiencies, and the measures taken to address them.

1. Leverantörer av kryptotillgångstjänster ska föra register över alla de policyer och förfaranden som de är skyldiga att dokumentera skriftligen enligt förordning (EU) 2023/1114 och dess genomförandeåtgärder.
1. Leverantörer av kryptotillgångstjänster ska också föra register över den bedömning och regelbundna översyn som deras ledningsorgan utför av ändamålsenligheten i de arrangemang och förfaranden för policyer som avses i artikel 68.6 i förordning (EU) 2023/1114, inbegripet eventuella brister som konstateras i samband med sådana arrangemang och förfaranden för policyer och eventuella åtgärder som vidtagits för att åtgärda sådana brister.
