Summary What does Article 5 of the ITS on supervisory cooperation say?

Article 5 directly follows Article 4, which governs how notifications and requests for cooperation are submitted.

This article deals with what happens next: how the receiving body must acknowledge and respond to those submissions.

It establishes a clear procedural obligation around timeliness and communication, ensuring the submitting body is not left without a response or update after sending a request.

Important points:

  • Receiving bodies are required to send an acknowledgement of receipt within 5 working days of receiving a notification or request, using the form in Annex II.
  • Where possible, the acknowledgement must include an estimated date of response.
  • Where no estimated date can be provided, the receiving body must instead commit to a regular update schedule for the submitting body.

    1. Det mottagande organet ska skicka ett mottagningsbevis till det inlämnande organet så snart som möjligt och under alla omständigheter inom 5 arbetsdagar efter mottagandet av en anmälan eller begäran enligt artikel 4, med användning av formuläret i bilaga II, och om möjligt ange ett beräknat svarsdatum.

    1. Om det inte är möjligt att ange ett beräknat svarsdatum ska det mottagande organet ange hur ofta det kommer att informera det inlämnande organet.
