Summary What does Article 2 of the ITS on supervisory cooperation say?

This article establishes the practical infrastructure for the cooperation and information exchange framework set out under Article 96 of Regulation (EU) 2023/1114 (MiCA).

It does so by requiring each competent authority to designate a dedicated contact point, communicate that contact point's details to ESMA and EBA, and ensures that ESMA and EBA maintain a live, up-to-date directory of all such contact points across Member States.

Important points:

  • Competent authorities are required to designate a contact point for cooperation and information exchange purposes, and notify ESMA and EBA of its details by 27 November 2024.
  • Competent authorities must keep ESMA and EBA informed of any changes to their contact point details on an ongoing basis.
  • ESMA and EBA are required to maintain and keep up-to-date a central list of all designated contact points.
