Summary What does Article 97 of the GDPR regulation say?
This article establishes a periodic review mechanism for the GDPR, placing the obligation squarely on the Commission to evaluate how the Regulation is functioning and report its findings to the European Parliament and the Council.
The review process is not a box-ticking exercise — it has a defined scope, requires input from Member States and supervisory authorities, and can lead to proposals to amend the Regulation itself.
Important points:
- The Commission is required to submit an evaluation report every four years, starting 25 May 2020, and these reports must be made public.
- The reviews must specifically examine the functioning of rules on international data transfers (Chapter V) and the cooperation and consistency mechanism (Chapter VII).
- The Commission may propose amendments to the Regulation on the back of these reviews, taking into account developments in information technology and the information society.

Senast den 25 maj 2020 och därefter vart fjärde år ska kommissionen överlämna en rapport om utvärderingen och översynen av denna förordning till Europaparlamentet och rådet.
Inom ramen för de utvärderingar och översyner som avses i punkt 1 ska kommissionen särskilt undersöka hur följande bestämmelser tillämpas och fungerar:
Kapitel V om överföring av personuppgifter till tredjeländer och internationella organisationer, särskilt när det gäller beslut som antagits enligt artikel 45.3 i den här förordningen och beslut som antagits på grundval av artikel 25.6 i direktiv 95/46/EG.
Kapitel VII om samarbete och enhetlighet.
Med avseende på tillämpningen av punkt 1 får kommissionen begära information från medlemsstaterna och tillsynsmyndigheterna.
Kommissionen ska när den utför de utvärderingar och översyner som avses i punkterna 1 och 2 ta hänsyn till ståndpunkter och slutsatser från Europaparlamentet, rådet och andra relevanta organ och källor.
Kommissionen ska om nödvändigt överlämna lämpliga förslag om ändring av denna förordning, med särskild hänsyn till informationsteknikens utveckling och mot bakgrund av tendenserna inom informationssamhället.
