Artikel 7 Betalningsvillkor och finansiella konsekvenser vid utebliven betalning
Summary What does Article 7 of the Methodology for calculating the supervisory fee say?
This short but consequential article sets out the payment rules for supervisory fees.
It establishes that fees must be paid in euro and in line with the terms set in the implementing decision issued under Article 6.
It then addresses the consequences of non-compliance with those payment terms, making clear that any shortfall will trigger recovery of the outstanding amount plus interest, and that this is entirely separate from any fines or periodic penalty payments that may also apply under the broader DSA framework.
Important points:
- Pay all supervisory fees in euro, strictly in accordance with the payment references set out in the Article 6(4) implementing decision.
- Late payment, partial payment, or non-payment will result in recovery of the unpaid amount together with interest, as calculated under Article 99(2) of Regulation (EU, Euratom) 2018/1046.
- Recovery of unpaid fees and interest does not replace or reduce any fines or periodic penalty payments that may separately apply under Articles 74 and 76 of Regulation (EU) 2022/2065.
