Art. 15 Övervakning och rapportering | Information sharing system | DSA

This article establishes the oversight and reporting obligations tied to AGORA's ongoing performance.

It tasks the Commission with continuously monitoring and evaluating AGORA, and requires it to produce periodic formal reports submitted to the European Parliament, the Council, and the European Data Protection Supervisor.

These reports must cover how AGORA is functioning, how well actors are using it, and how personal data protection is being handled.

To feed into this process, Digital Services Coordinators, the Board, and other competent authorities are required to supply the Commission with annual reports on their use of AGORA.

Important points:

The Commission is required to submit implementation reports starting 17 February 2027, and every three years after that, covering AGORA performance, information sharing, and data protection.
Each report must specifically address personal data protection and data security aspects of AGORA's operation.
Digital Services Coordinators, the Board, and other competent authorities are required to submit annual reports to the Commission to support the preparation of these reports.

1. Kommissionen ska regelbundet övervaka Agoras funktion och regelbundet utvärdera dess resultat.
1. Senast den 17 februari 2027 och därefter vart tredje år ska kommissionen till Europaparlamentet, rådet och Europeiska datatillsynsmannen överlämna en rapport om genomförandet av denna förordning. Rapporten ska innehålla information om den övervakning och utvärdering som utförts i enlighet med punkt 1 och om Agora-aktörernas resultat i samband med Agora i syfte att säkerställa ett effektivt informationsutbyte och lämpliga svar. I rapporten ska man också ta upp aspekter av genomförandet som rör skyddet av personuppgifter i Agora, inbegripet datasäkerhet.
1. För att utarbeta den rapport som avses i punkt 2 ska samordnarna för digitala tjänster, nämnden och andra behöriga myndigheter som beviljas åtkomst när det är nödvändigt för att de ska kunna utföra de uppgifter de tilldelats i enlighet med förordning (EU) 2022/2065 årligen förse kommissionen med all information som är relevant för tillämpningen av denna förordning i form av rapporter, inbegripet om tillämpningen av de krav på dataskydd och datasäkerhet som fastställs i den.
