Artikel 80 Offentliggörande av beslut

Summary What does Article 80 of the DSA regulation say?

This article deals with the publication of decisions made by the Commission in the context of enforcement proceedings against providers of very large online platforms and very large online search engines.

It sits within the enforcement section of the regulation, acting as a transparency obligation that follows on from the substantive decision-making powers set out in Articles 70, 71, and 73 to 76.

The Commission is required to make these decisions public, including naming the parties involved and disclosing any penalties, while at the same time balancing this transparency against the confidentiality interests of those affected.

Important points:

  • The Commission is required to publish its enforcement decisions, including the names of the parties and any penalties imposed.
  • Publication must have regard to the confidentiality interests of the platform or search engine concerned, other persons referenced in Article 67(1), and any third parties.
  • This article functions as the transparency counterpart to the Commission's enforcement powers, ensuring public visibility of outcomes in proceedings against very large online platforms and very large online search engines.
