Artikel 73 Bristande efterlevnad


Summary What does Article 73 of the DSA regulation say?

This article sets out the Commission's power to issue a formal non-compliance decision against providers of very large online platforms or very large online search engines.

It sits at the heart of the enforcement mechanism, acting as the culmination of investigatory proceedings that may have involved interim measures under Article 70 or binding commitments under Article 71.

The article establishes a structured process: the Commission must first share its preliminary findings with the provider before issuing a final decision, and that decision must specify what corrective measures the provider is required to take.

The provider must then report back on what it has actually done to comply.

Equally, the article provides a clean exit: if the Commission concludes that non-compliance has not been established, it closes the investigation by decision, with that closure taking immediate effect.

    1. Kommissionen ska anta ett beslut om bristande efterlevnad om den finner att den berörda leverantören av den mycket stora onlineplattformen eller mycket stora onlinesökmotorn inte uppfyller något av följande:

      1. De relevanta bestämmelserna i denna förordning.

      2. Interimistiska åtgärder som vidtagits enligt artikel 70.

      3. Åtaganden som gjorts bindande enligt artikel 71.

    1. Innan kommissionen antar ett beslut enligt punkt 1 ska den meddela den berörda leverantören av den mycket stora onlineplattformen eller mycket stora onlinesökmotorn sina preliminära slutsatser. I de preliminära slutsatserna ska kommissionen redogöra för de åtgärder som den överväger att vidta eller som den anser att den berörda leverantören av den mycket stora onlineplattformen eller mycket stora onlinesökmotorn bör vidta, för att på ett effektivt sätt agera enligt de preliminära slutsatserna.

I det beslut som antas enligt punkt 1 ska kommissionen ålägga den berörda leverantören av den mycket stora onlineplattformen eller mycket stora onlinesökmotorn att vidta de åtgärder som är nödvändiga för att säkerställa efterlevnaden av beslutet enligt punkt 1 inom en i det beslutet specificerad rimlig tidsperiod och att tillhandahålla information om de åtgärder som den leverantören avser att vidta för att följa beslutet.

    1. Den berörda leverantören av den mycket stora onlineplattformen eller mycket stora onlinesökmotorn ska förse kommissionen med en beskrivning av de åtgärder som den har vidtagit för att säkerställa efterlevnaden av beslutet enligt punkt 1 när de har genomförts.

    1. Om kommissionen finner att villkoren i punkt 1 inte är uppfyllda ska den avsluta undersökningen genom ett beslut. Beslutet skall tillämpas med omedelbar verkan.
