Summary What does Article 31 of the DSA regulation say?

This article sits within the section governing online platforms that allow consumers to conclude distance contracts with traders (online marketplaces), and it focuses on the design responsibilities of those platforms.

Leverantörer av onlineplattformar som gör det möjligt för konsumenter att ingå distansavtal med näringsidkare ska göra sitt bästa för att bedöma huruvida sådana näringsidkare har tillhandahållit den information som avses i punkterna 1 och 2 innan de tillåts att erbjuda produkter eller tjänster på de plattformarna. Efter att ha gjort det möjligt för näringsidkaren att erbjuda produkterna eller tjänsterna på sin onlineplattform som gör det möjligt för konsumenter att ingå distansavtal med näringsidkare, ska leverantören göra rimliga ansträngningar för att genom stickprov i officiella, fritt tillgängliga och maskinläsbara onlinedatabaser eller onlinegränssnitt, kontrollera huruvida de erbjudna produkterna eller tjänsterna har identifierats som olagliga.
