Artikel 25 Åtaganden


Summary What does Article 25 of the DMA regulation say?

This article establishes a commitments mechanism that sits within the context of systematic non-compliance proceedings under Article 18.

It allows a gatekeeper, during those proceedings, to proactively offer commitments to bring itself into compliance with its core obligations.

The Commission can then make those commitments legally binding and close the case.

However, the Commission retains the power to reopen proceedings under certain conditions, and if it finds the offered commitments insufficient, it must explain why it declined to make them binding.

Important points:

  • Gatekeepers may offer commitments during Article 18 proceedings, which the Commission can make legally binding and use to close the case.
  • The Commission may reopen proceedings if there is a material change in facts, the gatekeeper acts contrary to its commitments, the decision was based on incorrect or misleading information, or the commitments prove ineffective.
  • If the Commission rejects a gatekeeper's offered commitments as insufficient, it is required to provide reasons for that rejection in the closing decision.

    1. Om den berörda grindvakten under förfaranden enligt artikel 18 erbjuder åtaganden för de relevanta centrala plattformstjänsterna för att säkerställa efterlevnad av de skyldigheter som föreskrivs i artiklarna 5, 6 och 7, får kommissionen anta en genomförandeakt som gör dessa åtaganden bindande för den grindvakten och förklara att det inte finns några ytterligare skäl att vidta åtgärder. Den genomförandeakten ska antas i enlighet med det rådgivande förfarande som avses i artikel 50.2.

    1. Kommissionen får, på begäran eller på eget initiativ, genom beslut återuppta det relevanta förfarandet, om

      1. det har skett en väsentlig förändring av något av de sakförhållanden som ligger till grund för beslutet,

      2. den berörda grindvakten handlar i strid med sina åtaganden,

      3. beslutet grundades på ofullständiga, oriktiga eller vilseledande upplysningar från parterna,

      4. åtagandena inte är ändamålsenliga.

    1. Om kommissionen anser att de åtaganden som lämnats in av den berörda grindvakten inte kan säkerställa ett ändamålsenligt fullgörande av de skyldigheter som fastställs i artiklarna 5, 6 och 7, ska den förklara skälen till att dessa åtaganden inte gjorts bindande i beslutet om att avsluta de relevanta förfarandena.
