Artikel 24 Interimistiska åtgärder

Summary What does Article 24 of the DMA regulation say?

This article provides the Commission with an emergency tool to act swiftly when there is a risk of serious and irreparable damage to business users or end users of gatekeepers.

Rather than waiting for a full non-compliance decision under Article 29, the Commission can order interim measures against a gatekeeper based on a prima facie finding of an infringement of the core obligations laid down in Articles 5, 6 or 7.

Crucially, this power can only be exercised within the context of already open proceedings aimed at a non-compliance decision, meaning it is not a standalone mechanism but an accelerated tool embedded within that broader enforcement process.

Important points:

I brådskande fall, på grund av risken för allvarlig och irreparabel skada för grindvakters företagsanvändare eller slutanvändare, får kommissionen anta en genomförandeakt med beslut om interimistiska åtgärder mot en grindvakt på grundval av ett prima facie-konstaterande av en överträdelse av artikel 5, 6 eller 7. Den genomförandeakten ska antas endast i samband med förfaranden som inleds i syfte att eventuellt anta ett beslut om bristande efterlevnad i enlighet med artikel 29.1. Den ska gälla endast under en bestämd tidsperiod och får förnyas om det är nödvändigt och lämpligt. Den genomförandeakten ska antas i enlighet med det rådgivande förfarande som avses i artikel 50.2.
