Art. 10 Fastställande av tidsfrister | Conduct of certain Commission proceedings | DMA

This article governs how the Commission sets and potentially extends time limits under this Regulation and its parent Regulation (EU) 2022/1925.

It establishes that the Commission must weigh up all relevant facts, legal considerations, and interests when setting time limits, with particular attention to the right to be heard and the efficiency of proceedings.

It also creates a mechanism for undertakings to request extensions, subject to the Commission's assessment of whether the request is justified and whether granting it would risk breaching the procedural deadlines set out in Regulation (EU) 2022/1925.

Important points:

The Commission is required to consider all relevant facts, law, and interests — including the right to be heard — when setting time limits.
Undertakings or associations of undertakings may request an extension of a time limit, but the request must be reasoned and submitted before the original time limit expires.
The Commission will assess whether the extension request is sufficiently substantiated and whether granting it would endanger compliance with procedural time limits under Regulation (EU) 2022/1925.

När kommissionen fastställer en tidsfrist enligt förordning (EU) 2022/1925 eller den här förordningen ska den ta vederbörlig hänsyn till alla relevanta faktiska och rättsliga omständigheter och alla berörda intressen, särskilt möjligheten för enskilda att utöva sin rätt att bli hörd och förfarandets lämplighet.

Om så är lämpligt och på motiverad begäran av de berörda företagen eller företagssammanslutningarna före utgången av den tidsfrist som kommissionen fastställt i enlighet med förordning (EU) 2022/1925 eller den här förordningen, får en tidsfrist förlängas. När kommissionen fattar beslut om huruvida en sådan förlängning ska beviljas ska den bedöma om den motiverade begäran är tillräckligt underbyggd och om den begärda förlängningen riskerar att äventyra efterlevnad av de tillämpliga förfarandefrister som fastställs i förordning (EU) 2022/1925.
