Artikel 45 Utövande av delegeringen
Summary What does Article 45 of the Data act regulation say?
This is a procedural article that governs how the Commission exercises its power to adopt delegated acts under this regulation.
It sets out the conditions and safeguards attached to that delegated power, specifically in relation to Articles 29(7) and 33(2), which deal with switching charges monitoring and interoperability requirements for data spaces respectively.
The article establishes a framework of checks and balances involving the European Parliament and the Council, ensuring they retain oversight and control over the Commission's delegated powers.
Important points:
- The Commission is granted the power to adopt delegated acts under Articles 29(7) and 33(2) for an indeterminate period from 11 January 2024.
- The European Parliament or the Council may revoke this delegation of power at any time, though revocation does not affect the validity of delegated acts already in force.
- Delegated acts only enter into force if neither the European Parliament nor the Council objects within three months of notification, a period that either institution may extend by a further three months.
