Summary What does Article 23 of the Data act regulation say?

This article establishes the overarching obligation on providers of data processing services to actively enable customer switching.

It serves as the gateway article for the switching provisions of the regulation, directing providers to implement the specific measures detailed in subsequent articles (Articles 25 to 30).

The core thrust is that providers must not only refrain from creating obstacles to switching, but must also actively remove any that already exist — whether commercial, technical, contractual, or organisational in nature.

The goal is to give customers genuine freedom to move to a competing provider, to on-premises infrastructure, or even to use multiple providers simultaneously.

  • Providers of data processing services must enable customers to switch freely and remove all existing obstacles — across pre-commercial, commercial, technical, contractual, and organisational dimensions.

Leverantörer av databehandlingstjänster ska vidta de åtgärder som föreskrivs i artiklarna 25, 26, 27, 29 och 30 för att göra det möjligt för kunder att byta till en databehandlingstjänst som omfattar samma tjänstetyp och som tillhandahålls av en annan leverantör av databehandlingstjänster, eller till lokal IKT-infrastruktur, eller, i förekommande fall, att använda flera leverantörer av databehandlingstjänster samtidigt.   2. ingå nya avtal med en annan leverantör av databehandlingstjänster som täcker samma tjänstetyp,

  3. portera kundens exporterbara data och digitala tillgångar till en annan leverantör av databehandlingstjänster eller till lokal IKT-infrastruktur, även efter att ha utnyttjat ett gratiserbjudande,

  4. i enlighet med artikel 24 uppnå funktionell likvärdighet i användningen av den nya databehandlingstjänsten i IKT-miljön hos en annan leverantör av databehandlingstjänster som omfattar samma tjänstetyp,

  5. om det är tekniskt möjligt separera de databehandlingstjänster som avses i artikel 30.1 från andra databehandlingstjänster som tillhandahålls av leverantören av databehandlingstjänster.
