Artikel 84 Begäranden om information till Olaf
Summary What does Article 84 of the Anti-money laundering regulation (AMLR) say?
This brief article is the mirror counterpart to Article 83, which governs the obligations of FIUs toward OLAF.
Here, the direction is reversed: Article 84 sets out OLAF's obligations when an FIU requests information from it.
OLAF must respond to such requests in a timely manner, but is permitted to withhold or delay that response if doing so would negatively impact an ongoing investigation, provided it communicates this refusal or postponement to the FIU along with its reasons.
Important points:
- OLAF is required to respond in a timely manner to reasoned requests for information from an FIU, where that information is necessary for the FIU's functions.
- OLAF may postpone or refuse to provide information if it would negatively impact an ongoing investigation.
- OLAF must communicate any postponement or refusal to the requesting FIU, including the reasons for it.
