Art. 15 Begäran om bistånd från AI-byrån | Scientific panel of independent experts | AI act

This article sets out the conditions and formal requirements that govern how the scientific panel can request assistance from the AI Office in obtaining documentation or information from providers of general-purpose AI models.

It directly connects to Article 91(3) of Regulation (EU) 2024/1689, which provides the legal basis for the Commission to issue such requests.

The article establishes that this mechanism is not open to individual panel members acting alone, but requires a collective threshold of support within the panel, and imposes clear substantive requirements on what the request must demonstrate.

Important points:

Only the appointed rapporteur may submit a request for assistance to the AI Office, and only where at least one third of the scientific panel's members have authorised it.
The request must clearly identify the rapporteur and contributors, state its purpose, and substantiate both that the task cannot be carried out without the assistance and that the information requested does not exceed what is necessary.
Throughout the process, due regard must be given to the protection of trade secrets and confidential business information of general-purpose AI model providers.

Om den vetenskapliga panelen i enlighet med artikel 91.3 i förordning (EU) 2024/1689 begär att kommissionen ska utfärda en begäran om dokumentation eller information till en leverantör av AI-modeller för allmänna ändamål och bevilja tillgång till den mottagna informationen i den mån detta är nödvändigt och proportionellt för fullgörandet av en uppgift som avses i artikel 68.3 i förordning (EU) 2024/1689 (begäran om bistånd), ska vederbörlig hänsyn tas till behovet av att skydda företagshemligheter och konfidentiell affärsinformation.
1. En begäran om bistånd får lämnas till AI-byrån av den medlem av den vetenskapliga panelen som sekretariatet har utsett till föredragande för en av den vetenskapliga panelens uppgifter. En sådan begäran får endast göras om minst en tredjedel av den vetenskapliga panelens medlemmar har gett den föredragande tillstånd att göra det.

Begäran om bistånd ska innehålla en tydlig angivelse av namn på begärande föredragande och bidragslämnare samt syftet med det begärda biståndet och får endast göras för fullgörande av den vetenskapliga panelens uppgifter enligt artikel 68.3 i förordning (EU) 2024/1689. För att visa att en sådan begäran är nödvändig och proportionell i enlighet med artikel 91.3 i förordning (EU) 2024/1689, ska begäran styrka
  1. att ett avslag på begäran om bistånd kommer att hindra den begärande föredraganden från att utföra sin uppgift enligt artikel 68.3 i förordning (EU) 2024/1689,
  2. att den mängd, omfattning, detaljnivå och typ av dokumentation och information som begärs inte går utöver vad som är nödvändigt för att utföra uppgiften.
