Art. 14 Marknadskontrollmyndigheters begäranden om stöd | Scientific panel of independent experts | AI act

This article establishes the mechanism through which national market surveillance authorities can access the expertise of the scientific panel to support their enforcement activities under the AI Act.

It sets out the full lifecycle of such a request, from submission through to evaluation and outcome, with the AI Office acting as the gatekeeper that assesses whether engaging the scientific panel is warranted.

Approved requests lead to the appointment of panel members under the procedure set out in Article 7, while rejected requests must be communicated with reasons.

Important points:

The AI Office is required to provide a practical channel for market surveillance authorities to request scientific panel assistance, and must process such requests within two weeks of receiving a complete submission.
Market surveillance authorities must clearly state the purpose of their request and substantiate why it is necessary and proportionate, with requests only valid in the context of market surveillance activities under the AI Act.
The AI Office evaluates each request taking into account the scientific panel's available capacity and the need to ensure fair access to expert support across all Member States.

Varje begäran om bistånd från den vetenskapliga panelen ska innehålla en tydlig angivelse av syftet med det begärda biståndet och får endast göras i samband med marknadskontroll enligt förordning (EU) 2024/1689, och behovet av och proportionaliteten i begäran om bistånd från den vetenskapliga panelen ska motiveras.
1. AI-byrån ska bedöma om begäran om bistånd är nödvändig och proportionell, med beaktande av den vetenskapliga panelens tillgängliga kapacitet och det faktum att alla medlemsstater behöver ha faktisk tillgång till experter.
1. Om AI-byrån efter den bedömning som avses i punkt 3 drar slutsatsen att begäran är nödvändig och proportionell ska kommissionen utse en föredragande och två bidragslämnare för uppgiften i enlighet med artikel 7.
1. Om AI-byrån konstaterar att det begärda biståndet inte är nödvändigt och proportionellt ska den underrätta den begärande marknadskontrollmyndigheten och ange skälen till avslaget.
1. AI-byrån ska behandla begäran inom två veckor från mottagandet av den fullständiga begäran. AI-byrån får när som helst innan den fattar sitt beslut kräva att den begärande marknadskontrollmyndigheten tillhandahåller kompletterande information som styrker begäran. I sådana fall ska begäran inte anses fullständig förrän den kompletterande informationen har lämnats.
