Art. 37 Ifrågasättande av anmälda organs kompetens | AI act regulation | AI act

This article establishes the Commission's oversight role over notified bodies — the independent conformity assessment organisations that verify whether high-risk AI systems meet the requirements of the regulation.

It sets out the Commission's power to investigate notified bodies where their competence or continued compliance with the requirements of Article 31 is in doubt, and crucially, gives the Commission the ability to act directly if a Member State fails to address identified problems.

The Commission has the power to investigate notified bodies where their competence or ongoing compliance is in question.
Notifying authorities are required to supply the Commission with all relevant information on request to support these investigations.
Where a Member State fails to take corrective action against a non-compliant notified body, the Commission may itself suspend, restrict or withdraw the body's designation through an implementing act.

1. Kommissionen ska vid behov undersöka alla fall där det finns skäl att betvivla att ett anmält organ har tillräcklig kompetens eller att ett anmält organ fortsätter att uppfylla kraven i artikel 31 och fullgöra sitt tillämpliga ansvar.
1. Den anmälande myndigheten ska på begäran ge kommissionen all relevant information om anmälan eller upprätthållandet av det berörda anmälda organets kompetens.
1. Kommissionen ska säkerställa att all känslig information som den erhåller under sina undersökningar enligt denna artikel behandlas konfidentiellt i enlighet med artikel 78.
1. Om kommissionen konstaterar att ett anmält organ inte uppfyller eller inte längre uppfyller kraven för anmälan ska den informera den anmälande medlemsstaten om detta och anmoda den att vidta nödvändiga korrigerande åtgärder, inbegripet att om så är nödvändigt återkalla anmälan tillfälligt eller slutgiltigt. Om medlemsstaten inte vidtar nödvändiga korrigerande åtgärder får kommissionen genom en genomförandeakt begränsa utseendet eller återkalla det tillfälligt eller slutgiltigt. Den genomförandeakten ska antas i enlighet med det granskningsförfarande som avses i artikel 98.2.
