Article 13 Enregistrement de la réception et de la transmission d’ordres à des entités auxquelles le règlement (UE) 2023/1114 ne s’applique pas

Summary What does Article 13 of the RTS on record keeping say?

This article addresses a specific scenario that extends the record-keeping obligations established in earlier articles: where a crypto-asset service provider transmits an order to an entity that falls outside the scope of Regulation (EU) 2023/1114.

In such cases, the provider remains responsible for recording the details of that transmitted order.

The article also handles the situation where a single order is aggregated across multiple clients, ensuring that individual client details are captured for each one.

Important points:

  • Where you transmit an order to an entity outside the scope of Regulation (EU) 2023/1114, record the details of that order using the applicable fields in Table 2 of Section 2 of the Annex.
  • Where an order is aggregated for several clients, record the relevant client identification information individually for each client.
  • The client identification requirements in Articles 9 and 14 apply in full to aggregated orders.
