Summary What does Article 1 of the RTS on continuity and regularity say?

This is a short definitions article that establishes the precise meaning of two key terms used throughout the regulation.

Rather than creating entirely new concepts, it anchors one term to an existing definition in Regulation (EU) 2022/2554 and introduces a crypto-asset-specific concept relevant to the business continuity obligations that follow in subsequent articles.

Understand that "critical or important function" carries the same meaning as defined in Regulation (EU) 2022/2554, directly linking this regulation to that existing framework.
A "permissionless distributed ledger" is defined as one where no single entity is in control and anyone meeting the technical requirements can participate as a node — a concept that becomes relevant when assessing business continuity risks tied to decentralised infrastructure.

Aux fins du présent règlement, on entend par:

«fonction critique ou importante»: une fonction critique ou importante au sens de l’article 3, point 22), du règlement (UE) 2022/2554;
«registre distribué sans permission»: un type spécifique de registre distribué dans lequel aucune entité ne contrôle le registre distribué et dans lequel les nœuds de réseau DLT peuvent être mis en place par toute personne respectant les exigences techniques et les protocoles de ce registre distribué.
