Summary What does Article 147 of the MiCA regulation say?

This is a very brief amendment article that extends the whistleblower protection framework established under Directive (EU) 2019/1937 to cover MiCA.

It does so by inserting MiCA into the list of Union acts covered by that Directive, meaning that persons who report infringements of MiCA are entitled to the protections afforded to whistleblowers under that existing regime.

Article 147 works in direct connection with Article 116 of MiCA, which states that Directive (EU) 2019/1937 applies to the reporting of infringements of MiCA and the protection of persons making such reports.

Important points:

  • MiCA is added to the scope of the EU whistleblower protection directive, so reporting protections under that directive now extend to MiCA infringements.
  • This article amends an external piece of legislation rather than standing alone, meaning its practical effect is felt through Directive (EU) 2019/1937.
  • Member States are required to adopt and publish the national measures necessary to comply with this article by 30 December 2024.
