Summary What does Article 9 of the ITS on supervisory cooperation say?
This article sets out the procedural requirements for escalating unresolved cooperation requests to ESMA or EBA.

Lorsque l’AEMF, conformément à l’article 95, paragraphe 6, du règlement (UE) 2023/1114, ou l’ABE, conformément à l’article 95, paragraphe 7, dudit règlement, est saisie d’un rejet ou d’une absence d’action dans un délai raisonnable, la saisine se fait par écrit au moyen du formulaire figurant à l’annexe I et comprend:
une copie de la demande de coopération et d’échange d’informations et de toute réponse reçue;
les raisons pour lesquelles l’AEMF ou l’ABE est saisie de ce rejet ou de cette absence d’action.
