Summary What does Article 5 of the ITS on supervisory cooperation say?

Article 5 directly follows Article 4, which governs how notifications and requests for cooperation are submitted.

This article deals with what happens next: how the receiving body must acknowledge and respond to those submissions.

It establishes a clear procedural obligation around timeliness and communication, ensuring the submitting body is not left without a response or update after sending a request.

Important points:

  • Receiving bodies are required to send an acknowledgement of receipt within 5 working days of receiving a notification or request, using the form in Annex II.
  • Where possible, the acknowledgement must include an estimated date of response.
  • Where no estimated date can be provided, the receiving body must instead commit to a regular update schedule for the submitting body.

Dès que possible et, en tout état de cause, dans un délai de 5 jours ouvrables à compter de la réception d’une notification ou d’une demande effectuée conformément à l’article 4, l’organisme destinataire adresse, au moyen du formulaire figurant à l’annexe II, un accusé de réception à l’organisme émetteur, et indique, si possible, une date de réponse estimée.
