Summary What does Article 5 of the ITS on supervisory cooperation say?
Article 5 directly follows Article 4, which governs how notifications and requests for cooperation are submitted.
This article deals with what happens next: how the receiving body must acknowledge and respond to those submissions.
It establishes a clear procedural obligation around timeliness and communication, ensuring the submitting body is not left without a response or update after sending a request.
Important points:
- Receiving bodies are required to send an acknowledgement of receipt within 5 working days of receiving a notification or request, using the form in Annex II.
- Where possible, the acknowledgement must include an estimated date of response.
- Where no estimated date can be provided, the receiving body must instead commit to a regular update schedule for the submitting body.
Springlex's summary of the article, a reading aid, not a substitute for the legal text.
