Summary What does Article 4 of the ITS on competent authority information exchange say?
This article sits within the broader procedural framework established for cooperation between competent authorities and deals specifically with the acknowledgement stage of the request process.
Building on the request procedure set out in Article 3, it establishes how and when a requested authority must confirm receipt of a cooperation or information exchange request, and what that confirmation must contain.
It also provides a fallback mechanism for situations where a firm timeline for a full reply cannot yet be given.
Important points:
- Requested authorities are required to send an acknowledgement of receipt within 5 working days, using the prescribed form in Annex II, addressed to the designated contact point from Article 2.
- The acknowledgement should, where possible, include an estimated date or timeframe for the full reply.
- Where no estimated timeframe can be provided, the requested authority must instead commit to a regular update frequency for the requesting authority.

Dans un délai de cinq jours ouvrables à compter de la réception d’une demande de coopération ou d’échange d’informations, l’autorité sollicitée adresse, par courrier postal ou par voie électronique, un accusé de réception au point de contact désigné conformément à l’article 2, sauf indication contraire dans la demande. Cet accusé de réception est établi au moyen du formulaire figurant à l’annexe II et comporte, dans la mesure du possible, une indication de la date à laquelle, ou du délai dans lequel, il est estimé qu’une réponse sera fournie.
Lorsqu’il n’est pas possible d’indiquer une date ou un délai de réponse estimé(e), l’autorité sollicitée indique la fréquence à laquelle elle tiendra informée l’autorité demandeuse.
