Article premier Définition

Summary What does Article 1 of the ITS on competent authority information exchange say?

This is a short definitional article that exists solely to establish what is meant by "electronic means" within this Regulation.

It sets the technical foundation for how communications between competent authorities can be conducted throughout the rest of the Regulation, particularly where articles permit requests, replies, and transmissions to be made by electronic means.

Important points:

  • "Electronic means" covers any electronic equipment used for processing, storing, and transmitting data, regardless of the technology used (wires, radio, optical, or other electromagnetic).
  • The definition explicitly requires that completeness, integrity, and confidentiality of information are maintained during transmission.
  • This article underpins all subsequent provisions that permit or require communication by electronic means.

Springlex's summary of the article, a reading aid, not a substitute for the legal text.
