Article 76 Confidentialité

Summary What does Article 76 of the GDPR regulation say?

This is a brief procedural article governing transparency and access rules for the European Data Protection Board.

It covers two distinct but related aspects: when the Board's internal discussions may be kept confidential, and how external parties can access Board documents.

Rather than setting its own detailed access regime, the article defers to an existing EU framework for document access.

Important points:

The Board may hold confidential discussions where it deems this necessary, in line with its own rules of procedure.
Access to documents submitted to Board members, experts, and third-party representatives is governed by Regulation (EC) No 1049/2001, the EU's general public access to documents framework.
