Article 4 Simple transport


Summary What does Article 4 of the DSA regulation say?

This article establishes the "mere conduit" liability exemption for information society service providers involved in the transmission of information or the provision of network access.

It sets out the core principle that such providers are shielded from liability for the content they transmit, provided they play a purely passive role in that transmission.

The article also clarifies that incidental, temporary storage necessary to carry out the transmission falls within this exemption, and preserves the ability of judicial or administrative authorities to order providers to stop or prevent infringements regardless of this protection.

Important points:

  • As a mere conduit service provider, benefit from the liability exemption by ensuring you do not initiate the transmission, select the receiver, or select or modify the information transmitted.
  • Automatic, intermediate, and transient storage is covered by the exemption, as long as it serves solely the purpose of carrying out the transmission and is not retained longer than reasonably necessary.
  • Judicial and administrative authorities retain the power to require service providers to terminate or prevent an infringement, meaning this exemption does not override such orders.

    1. En cas de fourniture d’un service de la société de l’information consistant à transmettre, sur un réseau de communication, des informations fournies par un destinataire du service ou à fournir un accès à un réseau de communication, le fournisseur de services n’est pas responsable des informations transmises ou auxquelles l’accès est fourni, à condition que le fournisseur:

      1. ne soit pas à l’origine de la transmission;

      2. ne sélectionne pas le destinataire de la transmission; et

      3. ne sélectionne et ne modifie pas les informations faisant l’objet de la transmission.

    1. Les activités de transmission et de fourniture d’accès visées au paragraphe 1 englobent le stockage automatique, intermédiaire et transitoire des informations transmises, pour autant que ce stockage serve exclusivement à l’exécution de la transmission sur le réseau de communication et que sa durée n’excède pas le temps raisonnablement nécessaire à la transmission.

    1. Le présent article n’affecte pas la possibilité, pour une autorité judiciaire ou administrative, conformément au système juridique d’un État membre, d’exiger du fournisseur de services qu’il mette fin à une infraction ou qu’il prévienne une infraction.
