Summary What does Article 54 of the DMA regulation say?
This is the final article of the Digital Markets Act and serves as its entry into force and application provision.
It establishes when the regulation becomes legally operative, setting out a tiered timeline rather than a single uniform start date.
Certain provisions — primarily those relating to delegated acts, implementing acts, standardisation, advisory committees, and the high-level group — were given an earlier application date to allow the necessary institutional and procedural groundwork to be laid ahead of the main obligations taking effect.
A small number of other provisions have a slightly later application date, subject to a safeguard condition.
Important points:
- The regulation entered into force on the twentieth day after its publication in the Official Journal of the European Union, with general application from 2 May 2023.
- Articles covering delegated powers, implementing acts, guidelines, standardisation, and the advisory committee applied earlier, from 1 November 2022, to enable preparatory work before the main rules took effect.
- Articles 42 and 43 (on representative actions and whistleblower protection) apply from 25 June 2023, unless that date falls before the general application date, in which case they are postponed to align with it.

Cependant, l’article 3, paragraphes 6 et 7, ainsi que les articles 40, 46, 47, 48, 49 et 50 sont applicables à partir du 1, et les articles 42 et 43 sont applicables à partir du 25 juin 2023.
