Summary What does Article 22 of the DMA regulation say?

This article grants the Commission the power to conduct interviews as part of its investigative duties under the regulation.

It is a relatively brief provision that establishes the conditions under which interviews can take place, including the consent requirement and the involvement of national authorities when interviews occur on an undertaking's premises.

It connects directly to the Commission's broader investigative toolkit, complementing the inspection powers set out in Article 23.

Important points:

The Commission may interview any natural or legal person who consents, and is entitled to record those interviews by any technical means.
Where an interview takes place on an undertaking's premises, the Commission must inform the relevant national competent authority of the Member State in whose territory the interview is conducted.
National competent authority officials may assist the Commission in conducting the interview if that authority so requests.

Pour l’accomplissement de ses tâches au titre du présent règlement, la Commission peut entendre toute personne physique ou morale qui accepte d’être auditionnée, aux fins de la collecte d’informations, en lien avec l’objet d’une enquête. La Commission a le droit d’enregistrer ces auditions par tout moyen technique.
1. Lorsqu’une audition au titre du paragraphe 1 du présent article est menée dans les locaux d’une entreprise, la Commission en informe l’autorité nationale compétente de l’État membre chargée de faire appliquer les règles visées à l’article 1^er, paragraphe 6, et sur le territoire duquel l’audition a lieu. Si cette autorité le demande, les agents de celle-ci peuvent prêter assistance aux agents et aux autres personnes les accompagnant mandatés par la Commission pour conduire l’audition.
