Lorsque des sociétés sont détenues par l’intermédiaire d’une structure à multiples niveaux de propriété et que, dans une ou plusieurs chaînes de cette structure, on constate la coexistence d’une participation au capital et d’un contrôle en ce qui concerne différents niveaux de la chaîne, les bénéficiaires effectifs sont:

les personnes physiques qui contrôlent directement ou indirectement, par une participation au capital ou par d’autres moyens, les entités juridiques qui détiennent une participation directe au capital de la société, de manière individuelle ou cumulative;
les personnes physiques qui, de manière individuelle ou cumulative, détiennent directement ou indirectement une participation au capital de l’entité juridique qui contrôle directement ou indirectement la société, par une participation au capital ou par d’autres moyens.
