Art. 4 Mandat | Scientific panel of independent experts | AI act

This article sets out the terms and conditions governing the duration of membership on the scientific panel, as well as the procedures for dismissal and replacement.

It directly builds on Article 3, which establishes the selection and appointment process for experts, by defining what happens once experts are in post.

The article covers the two-year renewable term, the grounds and mechanism for dismissal, and how vacancies are to be filled mid-term.

Important points:

Experts are appointed for a two-year term, with the possibility of renewals.
The Commission may dismiss an expert who resigns or no longer fulfils the conditions referenced in Articles 10 and 13 of this Regulation or Article 339 of the Treaty on the Functioning of the European Union.
The Commission is required to appoint a replacement for any mid-term vacancy, drawing first from the reserve list established under Article 3, and must aim to ensure continuity of expertise, geographic representation and gender balance when doing so.

1. Les experts sont désignés membres du groupe scientifique pour un mandat de deux ans, renouvelable.
1. Lorsqu’un expert démissionne ou ne remplit plus les conditions énoncées aux articles 10 et 13 du présent règlement ou à l’article 339 du traité sur le fonctionnement de l’Union européenne, la Commission peut le révoquer.

Lorsqu’un expert est révoqué au cours de son mandat, un remplaçant de cet expert est désigné par la Commission pour la durée du mandat restant à courir à partir de la liste de réserve ou, le cas échéant, à la suite d’un appel à manifestation d’intérêt. Lorsqu’elle nomme un remplaçant, la Commission s’efforce d’assurer la continuité de l’expertise, la représentation géographique et l’équilibre entre les hommes et les femmes.
