Article 2 Legal Entity Identifiers

Summary What does Article 2 of the RTS on crypto-asset white paper classification say?

This article sets out specific requirements for persons drawing up crypto-asset white papers when using the ISO 17442 Legal Entity Identifier.

It connects directly to the broader white paper framework established under Regulation (EU) 2023/1114, specifically the articles governing white papers for crypto-assets, asset-referenced tokens, and e-money tokens.

The article essentially ensures that any Legal Entity Identifier used in these white papers meets recognised international standards and is verifiably registered within the global system.

Important points:

  • Persons drawing up a crypto-asset white paper must ensure any ISO 17442 Legal Entity Identifier used is valid and issued through a Local Operating Unit of the Global Legal Entity Identifier System.
  • The identifier must also be included in the Global Legal Entity Identifier database maintained by the Central Operating Unit appointed by the Regulatory Oversight Committee.
  • This obligation applies specifically in the context of white papers drawn up under Articles 6, 19, or 51 of Regulation (EU) 2023/1114.
