Article 93 Entry into force and application


Summary What does Article 93 of the DSA regulation say?

This is the final article of the Digital Services Act and deals with when the regulation enters into force and when it begins to apply.

While the regulation enters into force 20 days after publication, the general application date is set later, giving providers and authorities time to prepare.

Notably, a specific subset of provisions — largely those relating to oversight structures, delegated acts, supervisory fees, and the powers of the Commission and the Board — were brought into effect much earlier than the main application date, reflecting their foundational role in setting up the enforcement machinery ahead of the regulation's full rollout.

Important points:

  • The regulation applies from 17 February 2024 as the general application date for all providers of intermediary services.
  • A carve-out exists: several provisions relating to Commission powers, supervisory fees, and Board structures applied from 16 November 2022.
  • This article connects directly to Article 92, which sets an earlier application date for providers of very large online platforms and very large online search engines designated under Article 33.

    1. This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

    1. This Regulation shall apply from 17 February 2024.

    2. However, Article 24(2), (3) and (6), Article 33(3) to (6), Article 37(7), Article 40(13), Article 43 and Sections 4, 5 and 6 of Chapter IV shall apply from 16 November 2022.
