Article 89 Amendments to Directive 2000/31/EC


Summary What does Article 89 of the DSA regulation say?

This is a short but significant transitional and housekeeping article that directly links the Digital Services Act to its predecessor legislation, Directive 2000/31/EC (the E-Commerce Directive).

It removes the liability exemption provisions from that Directive and redirects anyone referencing those old provisions to the equivalent articles now contained within this Regulation.

In essence, it ensures a clean handover of the legal framework governing intermediary service liability from the old directive to the new regulation.

Important points:

  • Articles 12 to 15 of Directive 2000/31/EC are deleted and replaced by this Regulation.
  • Any existing references to those deleted articles must now be read as references to Articles 4, 5, 6 and 8 of this Regulation respectively.
  • This article ensures legal continuity, so that the shift from the old directive to the new regulation does not create gaps in the applicable rules.
