Article 44 Publication of decisions


Summary What does Article 44 of the DMA regulation say?

This article establishes the Commission's obligation to make its decisions public.

It covers a wide range of decision types under the Digital Markets Act — from gatekeeper designations and market investigations through to non-compliance findings and financial penalties — and sets out what that publication must include.

It is balanced by a protection clause ensuring that confidential information belonging to gatekeepers or third parties is handled with care during the publication process.

Important points:

  • The Commission is required to publish its decisions, including the names of the parties involved and the main content, inclusive of any penalties imposed.
  • The publication obligation spans a broad set of decision types, covering designation, compliance, enforcement, and financial penalty decisions made under the act.

    1. The Commission shall publish the decisions which it takes pursuant to Articles 3 and 4, Article 8(2), Articles 9, 10, 16 to 20 and 24, Article 25(1), Articles 29, 30 and 31. Such publication shall state the names of the parties and the main content of the decision, including any penalties imposed.

    1. The publication shall have regard to the legitimate interest of gatekeepers or third parties in the protection of their confidential information.
