Article 35 Annual reporting

Summary What does Article 35 of the DMA regulation say?

This article establishes an annual reporting obligation on the Commission, requiring it to keep the European Parliament and the Council informed on how the Digital Markets Act is being implemented and whether its objectives are being met.

The report serves as a structured accountability mechanism, covering the Commission's own enforcement activities, gatekeeper compliance, and the workings of the broader regulatory ecosystem, including cooperation with national authorities and the High Level Group of Digital Regulators.

The report must also be made publicly available on the Commission's website.

Important points:

  • The Commission is required to produce and submit an annual report to the European Parliament and the Council covering implementation and progress under this Regulation.
  • The report must include gatekeeper compliance findings, a review of the audited consumer profiling descriptions referred to in Article 15, and an overview of cooperation with national authorities.
  • The Commission must publish the report on its website, making it publicly accessible.
