Article 22 Power to carry out interviews and take statements


Summary What does Article 22 of the DMA regulation say?

This article grants the Commission the power to conduct interviews as part of its investigative duties under the regulation.

It is a relatively brief provision that establishes the conditions under which interviews can take place, including the consent requirement and the involvement of national authorities when interviews occur on an undertaking's premises.

It connects directly to the Commission's broader investigative toolkit, complementing the inspection powers set out in Article 23.

Important points:

  • The Commission may interview any natural or legal person who consents, and is entitled to record those interviews by any technical means.
  • Where an interview takes place on an undertaking's premises, the Commission must inform the relevant national competent authority of the Member State in whose territory the interview is conducted.

    1. In order to carry out its duties under this Regulation, the Commission may interview any natural or legal person which consents to being interviewed, for the purpose of collecting information, relating to the subject-matter of an investigation. The Commission shall be entitled to record such interviews by any technical means.

    1. Where an interview pursuant to paragraph 1 of this Article is conducted on the premises of an undertaking, the Commission shall inform the national competent authority of the Member State that is enforcing the rules referred to in Article 1(6) and in whose territory the interview takes place thereof. If that authority so requests, its officials may assist the officials and other accompanying persons authorised by the Commission to conduct the interview.
