Article 4 Format and length of documents

Summary What does Article 4 of the Conduct of certain Commission proceedings say?

This article establishes the formal requirements that documents submitted to the Commission must meet in terms of format and page limits, as defined in Annex II of this Regulation.

It also sets out the limited circumstances under which those limits can be exceeded, and what happens when a submission falls short of compliance.

Important points:

Ensure all documents submitted to the Commission comply with the format and page limits set out in Annex II.
The Commission may authorise exceeding page limits, but only upon a reasoned request where it is shown to be objectively impossible or exceedingly difficult to address particularly complex legal or factual issues within those limits.
The Commission may request undertakings or associations of undertakings to put non-compliant documents in order.

1. Documents submitted to the Commission under Regulation (EU) 2022/1925 shall comply with the format and page limits set out in Annex II to this Regulation.

The Commission may, upon reasoned request, authorise an undertaking or association of undertakings to exceed those page limits where and to the extent that the undertaking or association of undertakings substantiates that it is objectively impossible or exceedingly difficult to deal with particularly complex legal or factual issues within the relevant page limits.
