Article 7 Information sharing for supervisory purposes

Without prejudice to the measures set out in Section 4 of this Regulation, obliged entities shall not be prevented from sharing information from entities or branches of the groupmeans a group of undertakings which consists of a parent undertaking, its subsidiaries, as well as undertakings linked to each other by a relationship within the meaning of Article 22 of Directive 2013/34/EU; established in third countriesmeans any jurisdiction, independent state or autonomous territory that is not part of the Union and that has its own AML/CFT legislation or enforcement regime; to supervisorsmeans the body entrusted with responsibilities aimed at ensuring compliance by obliged entities with the requirements of this Regulation, including AMLA when performing the tasks entrusted to it in Article 5(2) of Regulation (EU) 2024/1620; in the Union.
Where the third countrymeans any jurisdiction, independent state or autonomous territory that is not part of the Union and that has its own AML/CFT legislation or enforcement regime;´s law restricts or prohibits the transfer of data to the supervisormeans the body entrusted with responsibilities aimed at ensuring compliance by obliged entities with the requirements of this Regulation, including AMLA when performing the tasks entrusted to it in Article 5(2) of Regulation (EU) 2024/1620; of the obliged entity in the Union, the obliged entity shall at least:
inform the supervisormeans the body entrusted with responsibilities aimed at ensuring compliance by obliged entities with the requirements of this Regulation, including AMLA when performing the tasks entrusted to it in Article 5(2) of Regulation (EU) 2024/1620; of the home Member State of such restrictions or prohibitions without undue delay and in any case no later than 28 calendar days after identifying the third countrymeans any jurisdiction, independent state or autonomous territory that is not part of the Union and that has its own AML/CFT legislation or enforcement regime; and the restrictions or prohibitions;
establish whether consent from the customer and, where applicable, their beneficial ownermeans any natural person who ultimately owns or controls a legal entity or an express trust or similar legal arrangement;, or any other means can be used to legally overcome restrictions or prohibitions.
