Article 17 Requests for information
The Authority may require selected obliged entitiesmeans a credit institution, a financial institution, or a group of credit institutions or financial institutions at the highest level of consolidation in the Union in accordance with applicable accounting standards, which is under direct supervision by the Authority pursuant to Article 13; and natural persons employed by them or legal persons belonging to them, and third parties to whom the selected obliged entitiesmeans a credit institution, a financial institution, or a group of credit institutions or financial institutions at the highest level of consolidation in the Union in accordance with applicable accounting standards, which is under direct supervision by the Authority pursuant to Article 13; have outsourced operational functions or activities and natural or legal persons affiliated to them, to provide it with all information it needs in order to carry out the tasks conferred on it by this Regulation and other applicable Union law.
The persons referred to in paragraph 1 or their representatives and, in the case of legal persons or associations having no legal personality, the persons authorised to represent them by law or by their constitution, shall supply the requested information without undue delay, ensuring that it is clear, accurate and complete. Lawyers duly authorised to act may supply the information on behalf of their clients. Those clients shall remain fully responsible where the information supplied is incomplete, incorrect or misleading.
Where the Authority obtains the information requested pursuant to paragraph 1, it shall make that information available to the financial supervisormeans the body entrusted with responsibilities aimed at ensuring compliance by obliged entities with the requirements of this Regulation, including AMLA when performing the tasks entrusted to it in Article 5(2) of Regulation (EU) 2024/1620; concerned.
