Summary What does Article 5 of the RTS on consultative supervisory colleges say?
This article sets out the process by which EBA manages the drafting and finalisation of the written coordination and cooperation agreement for the supervisory college, as referenced in Article 119(6) of Regulation (EU) 2023/1114.
It establishes a structured consultation loop: EBA proposes, members respond, EBA considers those responses, and the finalised agreement is then communicated back to the college members.

Die EBA übermittelt ihren Vorschlag für die in Artikel 119 Absatz 6 der Verordnung (EU) 2023/1114 genannte schriftliche Vereinbarung an die nach Artikel 119 Absatz 2 der genannten Verordnung bestimmten Mitglieder des Kollegiums und fordert sie auf, sich innerhalb von zehn Kalendertagen dazu zu äußern.
Bei der Fertigstellung der in Absatz 1 genannten schriftlichen Vereinbarung berücksichtigt die EBA alle von den Mitgliedern des Kollegiums geäußerten Standpunkte und Vorbehalte. Nimmt die EBA derartige Standpunkte oder Vorbehalte nicht in die schriftliche Vereinbarung auf, nennt sie die Gründe dafür.
Nach Fertigstellung der in Absatz 1 genannten schriftlichen Vereinbarung teilt die EBA den Mitgliedern des Kollegiums die schriftlichen Modalitäten der Koordinierung und Zusammenarbeit mit.
