Summary What does Article 7 of the ITS on competent authority information exchange say?

Article 7 sets out the practical communication standards that both the requesting and requested authorities must follow when cooperating and exchanging information.

It builds on the procedural framework established in Articles 4 and 5, adding obligations around how authorities communicate, how delays should be handled, and the general duty to cooperate in resolving any difficulties that arise during the execution of a request.

Both authorities must communicate using the most expedient means, accounting for confidentiality, correspondence times, volume of material, and ease of access.
The requested authority is required to provide a new estimated date or timeframe, with reasons, if it cannot meet the deadline referenced in Article 4(1).
The requested authority and the requesting authority are required to cooperate to resolve any difficulties that may arise in executing a request.

1. Die ersuchende und die ersuchte Behörde kommunizieren unter Verwendung des schnellsten Mittels, wobei Folgendes zu berücksichtigen ist:
  1. Vertraulichkeitserfordernisse;
  2. Antwortzeiten;
  3. Volumen des zu übermittelnden Materials;
  4. Zugänglichkeit der Informationen durch die ersuchende Behörde.
2. Die ersuchende Behörde beantwortet jedes Klarstellungsersuchen der ersuchten Behörde umgehend.

Kann bis zu dem in Artikel 4 Absatz 1 genannten voraussichtlichen Datum oder innerhalb des dort genannten Zeitrahmens keine Antwort übermittelt werden, so teilt die ersuchte Behörde der ersuchenden Behörde unter Angabe der Gründe für die Verzögerung ein neues voraussichtliches Datum oder einen neuen Zeitrahmen auf demselben Weg mit, auf dem sie den Eingang des Ersuchens bestätigt hat.
1. Die ersuchte und die ersuchende Behörde arbeiten zusammen, um sämtliche Schwierigkeiten, die bei der Ausführung eines Ersuchens entstehen können, zu beseitigen.
