Art. 5 Antwort auf ein Ersuchen um Zusammenarbeit oder Informationsaustausch | ITS on competent authority information exchange | MiCA

This article governs how the requested authority must respond to a request for cooperation or exchange of information.

Building on the acknowledgement of receipt process established in Article 4, Article 5 moves to the substance of the reply itself, setting out the obligations of the requested authority in terms of format, effort, timeliness, and what must happen if it refuses to comply.

It covers both full responses and situations where the requested authority can only partially or not at all fulfil the request.

Important points:

The requested authority is required to reply in writing using the prescribed form in Annex III, addressed to the designated contact point unless the request specifies otherwise.
The requested authority must take all reasonable steps within its powers to provide the requested information or assistance, and act without undue delay.
Where the requested authority refuses to act, in full or in part, it must inform the requesting authority as soon as possible in writing, citing the specific grounds for refusal under Article 95(2) of Regulation (EU) 2023/1114.

1. Die ersuchte Behörde übermittelt ihre Antwort auf das Ersuchen um Zusammenarbeit oder Informationsaustausch schriftlich, auf dem Postweg oder über elektronische Mittel. Sofern in dem Ersuchen nicht anders bestimmt, ist die Antwort an die gemäß Artikel 2 benannte Kontaktstelle zu richten. Benötigt die ersuchte Behörde zur Bearbeitung des Ersuchens um Zusammenarbeit oder Informationsaustausch weitere Informationen, so fordert sie auf beliebigem Wege umgehend weitere Klarstellungen an.
1. Die ersuchte Behörde verwendet für die Beantwortung des Ersuchens um Zusammenarbeit oder Informationsaustausch das Formular in Anhang III und
  1. unternimmt im Rahmen ihrer Befugnisse alle vertretbaren Schritte, um dem übermittelten Ersuchen um Informationen oder Amtshilfe nachzukommen;
  2. handelt unter Berücksichtigung der Komplexität des Ersuchens und der Notwendigkeit, Dritte oder eine andere zuständige Behörde einzubeziehen, unverzüglich.
1. Lehnt die ersuchte Behörde ein Ersuchen um Zusammenarbeit oder Informationsaustausch ganz oder teilweise ab, so teilt sie der ersuchenden Behörde ihre Entscheidung so bald wie möglich schriftlich — entweder auf dem Postweg oder über elektronische Mittel — mit und gibt dabei an, welche der in Artikel 95 Absatz 2 der Verordnung (EU) 2023/1114 genannten Gründe für die Ablehnung sie geltend macht.
