Artikel 77 Verjährungsfrist für die Verhängung von Sanktionen


Summary What does Article 77 of the DSA regulation say?

This article sets out the limitation period governing the Commission's power to impose fines and periodic penalty payments under Articles 74 and 76.

It establishes a five-year window within which the Commission must act, and provides clear rules on when that clock starts, when it is interrupted, and when it is suspended.

The article is a procedural safeguard that places a time boundary on enforcement action, ensuring that providers of very large online platforms and very large online search engines cannot face penalties for infringements indefinitely.

Important points:

  • The Commission has five years from the date an infringement is committed — or ceases, in the case of continuing or repeated infringements — to impose fines or periodic penalty payments.
  • The five-year limitation period is interrupted by investigative or procedural actions such as requests for information, inspections, or the opening of proceedings, with each interruption restarting the clock; however, an absolute outer limit applies of twice the original limitation period.
  • The limitation period is suspended for as long as the Commission's decision is subject to proceedings before the Court of Justice of the European Union.

Die Verjährungsfrist für die Verhängung von Geldbußen oder Zwangsgeldern endet jedoch spätestens an dem Tag, an dem ein Zeitraum verstrichen ist, der der doppelten Verjährungsfrist entspricht, ohne dass die Kommission eine Geldbuße oder ein Zwangsgeld verhängt hat. Diese Frist wird um den Zeitraum verlängert, in dem die Verjährungsfrist gemäß Absatz 5 ausgesetzt wurde.

    1. Die Verjährungsfrist für die Durchsetzung von Geldbußen oder Zwangsgeldern ruht, solange zu dem Beschluss der Kommission ein Verfahren vor dem Gerichtshof der Europäischen Union anhängig ist.
