Summary What does Article 32 of the DSA regulation say?

This article addresses the obligations of online marketplace platforms when they discover that a trader has been offering illegal products or services to consumers in the Union.

It sets out a two-track notification approach: direct communication to affected consumers where contact details are available, and public disclosure on the platform's interface where they are not.

The article connects closely to the broader trader accountability framework established in Articles 30 and 31, acting as the consumer-protection response mechanism when something goes wrong in that framework.

Important points:

  • Providers of online platforms allowing distance contracts must notify affected consumers of any illegal product or service, the trader's identity, and available means of redress.
  • This notification obligation is retrospective, covering only purchases made within the six months before the provider became aware of the illegality.
  • Where consumer contact details are unavailable, the provider must make the relevant information publicly accessible on its online interface.

    1. Erhält ein Anbieter einer Online-Plattform, die Verbrauchern den Abschluss von Fernabsatzverträgen mit Unternehmern ermöglicht, unabhängig von den verwendeten Mitteln Kenntnis, dass ein rechtswidriges Produkt oder eine rechtswidrige Dienstleistung von einem Unternehmer über seine Dienste Verbrauchern in der Union angeboten wurde, so informiert er – sofern ihm deren Kontaktdaten vorliegen – die Verbraucher, die das rechtswidrige Produkt oder die rechtswidrige Dienstleistung über seine Dienste erworben haben über Folgendes:

      1. die Tatsache, dass das Produkt oder die Dienstleistung rechtswidrig ist

      2. die Identität des Unternehmers und

      3. die einschlägigen Rechtsbehelfe.

    2. Die Pflicht nach Unterabsatz 1 gilt nur für den Erwerb von rechtswidrigen Produkten oder Dienstleistungen in den vergangenen sechs Monaten ab dem Zeitpunkt, zu dem der Anbieter von der Rechtswidrigkeit Kenntnis erlangt hat.

    1. Verfügt der Anbieter der Online-Plattformen, die Verbrauchern den Abschluss von Fernabsatzverträgen mit Unternehmern ermöglichen, in der in Absatz 1 genannten Situation nicht über die Kontaktdaten aller betroffenen Verbraucher, so macht dieser Anbieter die Informationen über das rechtswidrige Produkt oder die rechtswidrige Dienstleistung, die Identität des Unternehmers und die einschlägigen Rechtsbehelfe auf seiner Online-Schnittstelle öffentlich und leicht zugänglich.
