Summary What does Article 53 of the DMA regulation say?

This article establishes the periodic review mechanism for the Digital Markets Act as a whole.

It places an obligation on the Commission to evaluate the regulation on a recurring basis and report its findings to the European Parliament, the Council, and the European Economic and Social Committee.

The evaluation is substantive in scope, covering whether the regulation is achieving its core goals and whether its rules — including the list of core platform services and the obligations on gatekeepers — need to be updated or modified.

Notably, the Commission is also required to consider whether the interoperability obligations in Article 7 should be extended to online social networking services.

Important points:

  • The Commission is required to evaluate this Regulation by 3 May 2026 and every 3 years thereafter, reporting to the European Parliament, the Council, and the European Economic and Social Committee.
  • The evaluation must assess the regulation's impact on business users (especially SMEs) and end users, and may lead to appropriate measures including legislative proposals.
  • Competent authorities of Member States are required to provide the Commission with any relevant information needed to produce the evaluation report.

    1. Bis zum 3. Mai 2026 und danach alle drei Jahre wird die Kommission diese Verordnung evaluieren und dem Europäischen Parlament, dem Rat und dem Europäischen Wirtschafts- und Sozialausschuss einen Bericht vorlegen.

    1. In den Evaluierungen wird beurteilt, ob das Ziel dieser Verordnung, nämlich die Gewährleistung bestreitbarer und fairer Märkte, erreicht wurde, und ferner werden die Auswirkungen dieser Verordnung auf gewerbliche Nutzer, insbesondere KMU, und Endnutzer beurteilt. Darüber hinaus evaluiert die Kommission, ob der Geltungsbereich des Artikels 7 auf Online-Dienste sozialer Netzwerke ausgeweitet werden kann.

    1. Im Rahmen der Evaluierungen wird ermittelt, ob Vorschriften geändert werden müssen, etwa in Bezug auf die in Artikel 2 Nummer 2 aufgeführte Liste zentraler Plattformdienste und die in den Artikeln 5, 6 und 7 genannten Verpflichtungen und deren Durchsetzung, um sicherzustellen, dass die digitalen Märkte in der gesamten Union bestreitbar und fair sind. Im Anschluss an die Evaluierungen ergreift die Kommission geeignete Maßnahmen, wozu auch Gesetzgebungsvorschläge gehören können.

    1. Die zuständigen Behörden der Mitgliedstaaten übermitteln der Kommission alle ihnen vorliegenden einschlägigen Informationen, die diese für die Ausarbeitung des in Absatz 1 genannten Berichts benötigt.
