Artikel 32 Verjährungsfrist für die Verhängung von Sanktionen
Summary What does Article 32 of the DMA regulation say?
This article sets out the limitation period governing the Commission's power to impose fines and periodic penalty payments under Articles 30 and 31.
It establishes a 5-year window within which the Commission must act, and details the rules for when that clock starts, when it can be interrupted, and when it can be suspended.
Crucially, the Commission retains several tools to reset or pause this period, meaning the 5 years is not a simple countdown from the date of an infringement.
Important points:
- The Commission has 5 years from the date an infringement is committed to impose fines or periodic penalty payments, with the clock starting from the date the infringement ceases in the case of continuing or repeated infringements.
- The limitation period is interrupted by Commission actions such as requests for information, written authorisations for inspections, or the opening of proceedings — with each interruption starting the clock running afresh.
- The limitation period is suspended for as long as the Commission's decision is subject to proceedings before the Court of Justice, and cannot in any case exceed twice the original limitation period.

Für die der Kommission mit den Artikeln 30 und 31 übertragenen Befugnisse gilt eine Verjährungsfrist von fünf Jahren.
Die Frist läuft ab dem Tag, an dem die Zuwiderhandlung begangen worden ist. Im Fall andauernder oder wiederholter Zuwiderhandlungen läuft die Frist jedoch erst ab dem Tag, an dem die Zuwiderhandlung beendet wird.
Jede Handlung der Kommission zum Zwecke einer Marktuntersuchung oder Verfolgung einer Zuwiderhandlung unterbricht die Verjährungsfrist für die Verhängung von Geldbußen oder Zwangsgeldern. Die Unterbrechung tritt mit dem Tag ein, an dem die Handlung mindestens einem an der Zuwiderhandlung beteiligten Unternehmen oder einer beteiligten Unternehmensvereinigung bekannt gegeben wird. Die Verjährung wird unter anderem unterbrochen durch
Auskunftsverlangen der Kommission,
schriftliche Nachprüfungsaufträge, die die Kommission ihren Bediensteten erteilt hat,
die Einleitung eines Verfahrens nach Artikel 20 durch die Kommission.
Nach jeder Unterbrechung beginnt die Frist von Neuem. Die Verjährung tritt jedoch spätestens mit dem Tag ein, an dem die doppelte Verjährungsfrist verstrichen ist, ohne dass die Kommission eine Geldbuße oder ein Zwangsgeld verhängt hat. Diese Frist verlängert sich um den Zeitraum, in dem die Verjährung nach Absatz 5 ruht.
Die Verjährungsfrist für die Verhängung von Geldbußen oder Zwangsgeldern ruht, solange zu dem Beschluss der Kommission ein Verfahren vor dem Gerichtshof anhängig ist.
