Art. 13 Vertraulichkeit | Scientific panel of independent experts | AI act

This article sets out the confidentiality obligations that bind all experts on the scientific panel.

It establishes that experts must not disclose confidential information acquired through their panel work, and layers this requirement across multiple legal frameworks — the Treaty on the Functioning of the European Union and two specific Commission Decisions governing the protection of classified and sensitive non-classified information.

The article connects directly to Article 10, which addresses independence and conflicts of interest, together forming the core conduct standards experts must uphold throughout their membership.

Importantly, non-compliance with these confidentiality obligations carries a direct enforcement consequence: the Commission is empowered to take all appropriate measures, up to and including dismissal from the panel.

Die Sachverständigen geben keinerlei Informationen vertraulicher Art weiter, von denen sie während ihrer Arbeit im wissenschaftlichen Gremium oder als Ergebnis anderer unter diese Verordnung fallender Tätigkeiten Kenntnis erhalten. Zu diesem Zwecke unterschreiben sie eine Vertraulichkeitserklärung.
1. Die Sachverständigen müssen zudem den Artikel 339 des Vertrags über die Arbeitsweise der Europäischen Union einhalten.

Die Sachverständigen sind zur Einhaltung der in den Beschlüssen (EU, Euratom) 2015/443(³) und (EU, Euratom) 2015/444(⁴) der Kommission aufgeführten Vertraulichkeitsvorschriften zum Schutz von EU-Verschlusssachen und vertraulichen Informationen, die nicht zu den Verschlusssachen zählen, verpflichtet.
1. Werden die in den Absätzen 1, 2 und 3 genannten Verpflichtungen nicht eingehalten, kann die Kommission alle erforderlichen Maßnahmen ergreifen, einschließlich der Entlassung des Sachverständigen aus dem wissenschaftlichen Gremium.
